Acceptance of Terms
These Terms of Service (“Terms”) govern your access to and use of the AskShelf platform, website, and related services (collectively, the “Service”) provided by DataHase Technologies (“DataHase,” “we,” “our,” or “us”), operating through datahase.com. By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, you may not use the Service.
Service Description
AskShelf is an AI-powered voice agent platform designed for physical retail stores in India. The Service enables store owners to:
- Create and manage product catalogs with AI-generated product pages
- Deploy AI voice agents that customers can access by scanning QR codes in-store
- Receive analytics on customer interactions, product inquiries, and QR scan traffic
- Manage multi-branch stores and team access
- Import products in bulk via CSV upload or URL scraping
- Generate and manage QR codes for individual products and store locations
The AI voice agent supports 70+ languages. Voice conversations are processed in real time; audio is never recorded or stored.
Account Terms
AskShelf accounts are organization-based. A store owner creates an organization and may invite team members with defined roles (Owner, Admin, Member). You agree to the following:
- You must provide accurate, complete information when creating an account
- You are responsible for maintaining the confidentiality of your account credentials
- You are responsible for all activity that occurs under your account and organization
- You must immediately notify us of any unauthorized access to your account
- You must be at least 18 years of age to create an account
- Organization owners are responsible for managing team member permissions and access levels
Acceptable Use
You agree not to use the Service to:
- Violate any applicable laws, regulations, or third-party rights
- Upload fraudulent, deceptive, or misleading product information
- Misuse the AI voice agent for purposes other than legitimate retail product inquiries (such as generating harmful content, impersonation, or spam)
- Attempt to gain unauthorized access to our systems, other users’ accounts, or the AI model
- Reverse engineer, decompile, or attempt to extract the source code of the Service
- Scrape, harvest, or programmatically collect data from the Service without authorization
- Upload product information that infringes on intellectual property rights
- Interfere with or disrupt the Service, its infrastructure, or other users’ access
We reserve the right to suspend or terminate accounts that violate these terms without notice.
AI-Generated Content
The AskShelf AI voice agent generates responses based on the product data you provide. You acknowledge and agree that:
- AI responses may occasionally contain inaccuracies, hallucinations, or outdated information
- You are responsible for the accuracy and completeness of the product data you upload, which directly affects AI response quality
- AskShelf does not guarantee the accuracy, completeness, or suitability of any AI-generated content
- AI-generated product descriptions and responses should not be treated as professional advice (medical, legal, financial, or otherwise)
- You should regularly review AI responses by checking conversation transcripts to ensure they align with your product information
Voice & Transcription Terms
When end customers interact with your store’s AI voice agent:
- Audio is streamed in real time and is never recorded or stored permanently
- Text transcriptions of conversations are generated and stored for analytics purposes
- Customers are informed that their conversation will be transcribed before the voice session begins
- Store owners may access, review, and delete transcriptions at any time through the platform
- Store owners are responsible for ensuring that the use of transcription complies with local privacy laws applicable to their customers
Payment Terms
Subscription Plans
AskShelf offers subscription-based pricing tiers. Each plan includes a defined allocation of AI voice minutes, branches, team members, and features. Plan details and pricing are available on our website and may be updated with 30 days’ notice.
Billing
Paid subscriptions are billed monthly or annually. All payments are processed through Dodo Payments, our Merchant of Record (MoR). Dodo Payments handles payment processing, tax calculation, invoicing, and regulatory compliance on our behalf. All prices are listed in US Dollars (USD) unless otherwise stated. Applicable taxes are calculated and collected by Dodo Payments based on your location.
AI Voice Minutes & Usage
Each plan includes a monthly allocation of AI voice minutes. We implement a soft limit approach: we will never interrupt an active voice session, even if you exceed your monthly allocation. Overage charges may apply as described in your plan details. You will receive an email notification at 90% usage.
Cancellation & Refunds
You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of your current billing period. Refunds are processed through Dodo Payments and are subject to our Refund Policy. For annual subscriptions, refund requests within the first 30 days will be considered on a case-by-case basis.
Data Ownership
Store owners retain full ownership of their data:
- Product data: All product information you upload (names, descriptions, prices, images, specifications) remains your property
- Analytics data: Interaction data and analytics generated from customer voice sessions belong to you
- Customer form data: Any customer information collected through your configured forms belongs to you
By uploading content to AskShelf, you grant us a non-exclusive, worldwide, royalty-free license to use, display, cache, and process your content solely for the purpose of providing and improving the Service. This license terminates when you delete your content or close your account.
We may use anonymized, aggregated data derived from platform usage for internal research and product improvement purposes. This aggregated data cannot be used to identify individual users or stores.
Intellectual Property
The AskShelf platform -- including its technology, design, branding, documentation, and all related intellectual property -- is and remains the exclusive property of Datahase Dev Private Limited. Nothing in these Terms grants you any right, title, or interest in our intellectual property except the limited right to use the Service under these Terms.
Platform Availability
We strive to maintain high availability of the Service but do not guarantee uninterrupted or error-free operation. Specifically:
- We may perform scheduled maintenance with advance notice where practicable
- No formal Service Level Agreement (SLA) is provided unless you are on an Enterprise plan with a separately negotiated SLA
- We reserve the right to modify, suspend, or discontinue any aspect of the Service with reasonable advance notice
- Third-party service outages (such as AI model provider downtime) are beyond our control
Termination & Data Export
Termination by You
You may close your account at any time through your account settings. Before closing, you will have the opportunity to export your product data, analytics, and transcriptions in standard formats.
Termination by Us
We may suspend or terminate your access if you violate these Terms, engage in abusive conduct, or fail to pay subscription fees. In non-emergency cases, we will provide 14 days’ notice and an opportunity to resolve the issue before termination.
After Termination
Upon account termination, we will retain your data for 30 days to allow for export. After 30 days, all account data -- including product information, analytics, and transcriptions -- will be permanently deleted, except where retention is required by law.
Limitation of Liability
To the maximum extent permitted by applicable law, DataHase Technologies and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service. This includes but is not limited to loss of profits, data, business opportunities, or goodwill.
Our total aggregate liability for all claims arising from or related to the Service shall not exceed the total amount paid by you to AskShelf in the twelve (12) months immediately preceding the event giving rise to the claim.
The AI voice agent is provided “as is.” We do not warrant that AI responses will be accurate, complete, or suitable for any particular purpose. You use AI-generated content at your own discretion.
Indemnification
You agree to indemnify, defend, and hold harmless DataHase Technologies and its affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party rights; (d) the product content you upload; or (e) your use or distribution of AI-generated content from the platform.
Governing Law
These Terms are governed by and construed in accordance with the laws of India. Any disputes arising from or related to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts in Kerala, India.
Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will notify you by email and by posting a notice on the platform at least 30 days before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the revised Terms.
